Call to Order
Chair Fjelstad called the meeting
to order at 6:34 pm.
Members Present:
Anne Collopy, Margo Fjelstad, Ben
Lehman, LuAnne Pederson, and Nancy O?Brien
Members Absent:
None.
Others Present:
City Manager Bill Malinen and City
Attorney Mark Gaughan
II.
Approve Minutes of August 8, 2012 Meeting
Lehman moved, Pederson seconded
approval of the minutes of the August 8, 2012 meeting, as presented.
Ayes all.
III.
Discuss Ethics Complaint Received October 4, 2012
Chair Fjelstad thanked Attorney Gaughan
for providing a clear and understandable report for the Commission to work
from. Procedures for responding to a complaint were listed on page four of
Gaughan?s report and include:
The investigation and
fact-finding of an ethics complaint are conducted by the City Attorney?s
office per the Roseville Code of Ethics.
The Ethics Commission receives
the report from the investigation conducted by the City Attorney and has
certain actions it can take, but the Commission is not authorized to conduct
its own investigation.
The Ethics Commission is not
authorized to conduct public hearings as some of the other Commissions are.
The Ethics Commission can take
public comment if it wishes, but is not required to do so.
O?Brien asked about the definition
of political campaign activity. Attorney Gaughan indicated the ?plain
meaning? of political campaign activity would constitute activity. Gaughan
indicated it didn?t follow any State law, because it?s a City Code. Collopy questioned
whether partisan ?political campaigns? should be a part of the definition. O?Brien
suggested City officials be provided with a clearer understanding of political
campaign activity. Pederson asked if Gaughan could provide some guidance from
State Statutes and Gaughan responded that the State Code wouldn?t offer much
guidance. O?Brien noted a desire for more information or any guidance when
Council is part of the complaint.
The Commission generated a few
ideas including exploring the definition of political campaign activity and
outlining the complaint process especially when the Council is involved.
Fjelstad moved, Pederson seconded
to form a subcommittee of Lehman and Fjelstad to develop recommendations on
definitions and process for future meeting.
Ayes all.
Lehman moved, Fjelstad seconded
accepting the City Attorney?s report and recommend that the City Council
approve the report.
Ayes all, Collopy Abstained.
The Complainant, John Kysylyczyn,
wanted the record to reflect he wished to withdraw the complaint and re-file.
IV.
Discuss 2013 April Training Session
The Commission discussed having
former Mayor Craig Klausing as the speaker for the 2013 April Ethics
Training. The Commission also discussed using Audience Response Units during
the training for interaction.
V.
Discuss Ethics Tip
Pederson drafted November?s
Ethics Tip discussing gift giving.
O?Brien moved, Lehman seconded to
publish the November Ethics Tip as presented.
Ayes all.
VI.
Set 2013 Meeting Schedule
Pederson moved, Fjelstad seconded
to approve the 2013 meeting schedule.
Ayes all.
VII. Other
Business.
Collopy indicated that the State
of Minnesota?s Information Policy Analysis Division was holding a meeting to
explain open meeting and data practices. Collopy asked what the policy was on
media comments. City Manager said he provides official comments and the City
Council can as well.
VIII. Adjourn
There being no further business, Lehman
moved, Pederson seconded to adjourn the meeting at 7:05 p.m. Ayes all.
